§ 3116. Notice of impact of diplomatic and consular post closings on intelligence community

  • (a) The Secretary of State shall provide notice to the Director of National Intelligence and the Secretary of Defense of any covered closure of a diplomatic or consular post. To the maximum extent practicable, the notice shall be provided at least 30 days before the date on which the covered closure occurs.
  • (b) The Director of National Intelligence, in consultation with the heads of the other appropriate elements of the intelligence community as determined by the Director, shall submit to the appropriate congressional committees a notice describing the impact of the closure on the intelligence community. The notice shall be submitted within 30 days after the date on which the Director receives the notice under subsection (a) and, to the maximum extent practicable, shall be submitted before the date on which the covered closure occurs. Such notice shall include a description of whether, and the extent to which, the Director and the heads of the other appropriate elements of the intelligence community were consulted in the decision-making process with respect to such closure and registered any concerns with or objections to such closure.
  • (c) In this section:
    • (1) The term “appropriate congressional committees” means—
      • (A) the congressional intelligence committees;
      • (B) the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives;
      • (C) the Committees on Armed Services of the Senate and the House of Representatives; and
      • (D) the Committees on Appropriations of the Senate and the House of Representatives.
    • (2) The term “covered closure of a diplomatic or consular post” means the closure of a United States diplomatic or consular post abroad that is anticipated to last for 60 days or more.
